Brexit transition means Britain to lose all influence on 182 new EU rules

Britain could be left with no say on 182 new rules from the EU during the UK’s Brexit transition phase - when the British government will lose all influence in EU decision-making but be forced to adopt all new regulations under the terms of the deal - according to new analysis by the People’s Vote campaign.  

The EU Commission proposals due to come into force during transition include new rules on:

  • How UK taxpayer money is spent;
  • How alcohol is taxed;
  • How we mark our roads and design road signs;
  • What rules UK investment funds need to follow;

and even:

  • How we define British drinking water.

 

During the transition period all EU rules will continue to apply to the UK as if it were a member state. Changes to EU laws and rules adopted by EU institutions, bodies, offices and agencies during that period would also apply in the UK. All existing EU regulatory, budgetary, supervisory, judiciary and enforcement instruments and structures will also apply, including the competence of the Court of Justice of the European Union.

However, the UK will no longer participate in the institutions and the decision-making of the EU. The UK will no longer attend meetings of Commission experts groups, committees or other similar entities where member states are represented. The UK may be invited to attend meetings, but will have no voting rights at all.

 

This leaves Britain as a rule-taker, not a rule-maker. 

The new analysis identifies 182 EU Commission proposals that will be subject to discussion by the EU during the transition phase. That is 182 rules Britain will not have a say over, including:

  1.  Losing control of how our money is spent: The EU will prioritise and decide the allocation of its budget, which includes British taxpayers money, by policy area throughout 2019. The discussions and approval or rejection of the EU Commissions proposals for the Multiannual Financial Framework (MFF) will not involve any UK Government ministers or elected British MEPs, leaving the UK without a say on how our own money is spent.
  2. No say in how our alcohol is taxed: The EU will decide on new rules for how excise duty on alcoholic beverages is charged, and which products should qualify for what level. The discussions and approval or rejection of the EU Commissions proposals for Structures of excise duties on alcohol and alcoholic beverages will not involve any UK Government ministers or elected British MEPs, leaving the UK without a say on how our booze is taxed. Chris Bryant MP, a leading supporter of People’s Vote, said: 

“This analysis sets out for the first time the full scale of the UK’s capitulation under this so-called deal. The Prime Minister’s deal would weaken our ability to have a say in over 180 crucial decisions that are going to be made in Europe while the UK is in transition – meaning we have to abide by their rulings but have no say and no ability to protect Britain’s interests.   

“This dodgy deal will leave Britain frozen out of decision making and forced to pay billions of Euros for the privilege. Being a rule taker means being told how much we must tax our drinks, how clean our drinking water can be and even what our road signs look like, but having no control or influence, and in many areas being forced to accept EU rules even long after the transition period is over.

“A choice between a dodgy deal and no deal is no choice at all. The British public deserve a real choice between leaving the EU on these terms or sticking with the deal we’ve got inside the EU. Both the Prime Minister and the President of the European Council now  accept that stopping this deal could mean ‘no Brexit’. MPs must block this deal and then hand the final say on this crucial decision back to the public because only the people can sort this out.”
